Apple has been sued for trademark infringment by iCloud Communications LLC, a Phoenix, AZ based business VoIP company, which claims that Apple's use of 'iCloud' would materially impact its business. The company has been using the iCloud Marks trademark since 2005.
According to complaint documents posted online by Scribd, iCloud Communications says that Apple's use and massive promotion of its recently launched iCloud service may take away from its business. The complaint provides a concise background on Apple's history of infringing on trademarks of other companies, dating back to the 1970 case of the Beatles record label, followed by those of McIntosh Labs, Mighty Mouse, and more recently Cisco, which owned the trademark for the iPhone. It also talks about Apple being sued by Fujitsu Frontech for the use of 'iPad' and by Innovative Media Group for using 'iAds' for its mobile advertising program. The background attempts to establish Apple's history as a repetitive infringer of trademarks.
iCloud Communications maintains that Apple's use of iCloud damages its reputation and cause a loss of goodwill to its business, besides causing confusion in the minds of its customers about the source of services offered. |
