Autodesk and SolidWorks Corp settle trademark lawsuit |

Autodesk and SolidWorks have agreed settle a pending lawsuit over trademark infringments and have inked a confidential settlement agreement to dismiss all claims. Autodesk provides 2D and 3D design, engineering and entertainment software for the manufacturing, building and construction, and media entertainment markets. It tried to trademark "DWG," which it uses on its packaging, and sued SolidWorks in 2008 for the inappropriate use of its trademarks. For its part, SolidWorks, a subsidiary of 3-D design software maker Dassault Systèmes SA, which is part of the French conglomerate Groupe Industriel Marcel Dassault S.A, said that trademarks could not be used to protect functions such as file extensions. SolidWorks develops and markets software for design, analysis, product data management, and documentation, and makes software similar to that of Autodesk. It has products named DWGeditor and DWGviewer. In counterclaims, Solidworks had said that trademarks could not be used to protect functions such as file extensions. Media reports spoke of last minute courtroom dramatics where the hudge ensured that lawyers representing the two companies amended their draft agreement,which initially claimed that "a judgment was entered" in favor of Autodesk's markBoth lawyers had to scramble to redraft the agreement, which in its final draft said both companies agree to DWG being a valid trademark, while emphasising twice that the court did not rule on the issue. |
