Oracle is reported to be seeking an additional $211.6 million in interest on from SAP, over an above the damages of $1.3 billion that it was awarded on November 23, 2010 in a copyright infringement case pertaining to a company called TomorrowNow that SAP had acquired.
Oracle is said to hold the view that SAP owes it interest on the verdict awarded by a jury on November 23 dating back to 2005 and 2006, which is when SAP should have licensed the software where copyrights were infringed, according to a proposed judgment filed Friday in a federal court in San Francisco.
SAP paid Oracle $120 million in legal costs in the first week of November, prior to the jury awarding a penalty. The jury saw SAP as liable for the market value for licenses to use the software at the time. SAP, on the other hand, maintains that Oracle is not entitled to any additional compensation, “beyond the final judgment in this case.” The company is said to be considering all available options, including appealing the verdict, though it is yet to file an appeal. |
