Software giant Oracle has sued Internet and search giant Google over alleged patent infringement by the latter's Android operating system, reports said. Oracle says that Google's Android infringes on patents for Java held by its recently acquired Sun Microsystems. In a complaint filed in the US District Court for the Northern District of California, reports said that Oracle has alleged that Google's Android operating system contains Java applications and other technology, which it says infringes on seven different patents and on Java copyrights. Oracle is reported to be seeking an injunction to halt Google from the further development and distribution of Android besides demanding monetary damages for willful and deliberate infringement. Google had recently claimed sales of around 200,000 Android-powered phones a day.Media reports also speculated about the impact of the suit on Google's Android operating system, the benefits that would accrue to rival mobile phone operating systems such as Apple's iOS and RIM's Blackberry, and the broader implications for the open source community. Google, reports said, called the lawsuit an attack on the open-source community that uses Java. It termed the suit as baseless in a statement to USA Today, saying that it was disappointed and would defend open-source standards. Both Oracle and Google are licensees of the Open Invention Network, an organization that shares its patent portfolio with an entity that agress not to assert patent claims against the Linux System.
Reports quoted James Gosling, the software developer said to be the father of Java, saying on his blog, “ During the integration meetings between Sun and Oracle where we were being grilled about the patent situation between Sun and Google, we could see the Oracle lawyer's eyes sparkle.” Gosling had left Sun after its acquisition by Oracle earlier this year. “Filing patent suits was never in Sun's genetic code,” he said. |
